Welcome to Questionnaire. These Terms of Service ("Terms") govern your access to and use of our platform, services, and website. By accessing or using Questionnaire, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

By creating an account, accessing, or using the Questionnaire platform, you agree to comply with and be bound by these Terms of Service, our Privacy Policy, and User Policy. If you are using Questionnaire on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Questionnaire is a smart exam and question generator platform that enables users to:

Upload documents (PDF, DOCX, and other supported formats) for processing
Generate AI-powered questions automatically from uploaded documents
Create and customize exams with various question types
Set time limits and configure exam parameters
Share exams with students, team members, or participants
Track and analyze exam performance and results
Organize questions and documents by categories
Manage user accounts and permissions

3. User Accounts

To access certain features of Questionnaire, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your password and account
Accept all risks of unauthorized access to your account
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account

4. Subscription Plans and Pricing

Questionnaire offers various subscription plans with different features and limitations. Subscription fees are billed in advance on a recurring basis (monthly or annually). You agree to pay all fees associated with your chosen plan. We reserve the right to change our pricing with 30 days' notice. Continued use of the service after price changes constitutes acceptance of the new pricing.

5. Free Trial and Refunds

We may offer free trials for new users. At the end of the trial period, your subscription will automatically begin unless you cancel before the trial ends. Refund policies are determined on a case-by-case basis. Contact our support team for refund requests.

6. Intellectual Property Rights

The Questionnaire platform, including its software, design, text, graphics, logos, and other content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for its intended purpose. You may not:

Copy, modify, or create derivative works of the platform
Reverse engineer, decompile, or disassemble any part of the service
Remove or alter any proprietary notices or labels
Use the service to build a competitive product or service
Sell, rent, lease, or sublicense access to the platform

7. User Content and Data

You retain all rights to the content you upload to Questionnaire (documents, questions, exams, etc.). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely for providing and improving our services. You represent and warrant that you have all necessary rights to the content you upload and that it does not violate any third-party rights or applicable laws.

8. AI-Generated Content Disclaimer

Questionnaire uses artificial intelligence and machine learning to generate questions from uploaded documents. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or biases. You are solely responsible for reviewing, editing, and validating all AI-generated content before use. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated questions for any particular purpose.

9. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Violating any laws, regulations, or third-party rights
Uploading malicious code, viruses, or harmful content
Attempting to gain unauthorized access to the platform or other users' accounts
Interfering with or disrupting the service or servers
Using the service for any fraudulent, deceptive, or misleading purposes
Harassing, abusing, or harming other users
Collecting or harvesting personal information from other users
Using automated systems (bots, scrapers) without our permission
Reselling or redistributing the service without authorization

10. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any aspect of the service at any time without prior notice. We are not liable for any modification, suspension, or discontinuance of the service.

11. Termination

We reserve the right to suspend or terminate your account and access to the service at any time, with or without cause or notice, for any reason including violation of these Terms. Upon termination, your right to use the service will immediately cease. You may cancel your account at any time through your account settings. Upon cancellation, you may lose access to your content and data.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTIONNAIRE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14. Indemnification

You agree to indemnify, defend, and hold harmless Questionnaire, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

15. Data Protection and Privacy

Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using Questionnaire, you consent to our data practices as described in the Privacy Policy.

You agree to comply with all applicable export and import control laws and regulations. You shall not export or re-export the service or any related technical data to any country, person, or entity subject to export restrictions.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and User Policy, constitute the entire agreement between you and Questionnaire regarding the use of the service and supersede all prior agreements and understandings.
